What is a trademark? A trademark is used in the marketplace to protect the rights of innovators who have built an identity or service around a name, symbol, or product. Unlike patents, trademarks can be renewed indefinitely.

Evidence of the use of trademarks dates back to prehistoric times. Archaeologists note that symbols painted onto the likenesses of animals indicate presumed ownership. In later times, the Roman Empire stamped the bricks used to construct buildings noting their ownership.

In modern United States law, the Lanhan Act recorded on July 5, 1946 began to clarify how trademarks are perceived and ruled upon in the courts. During recent years the registration of trademarks has grown astronomically due to the explosive growth of the Internet. Certification Mark
A certification mark is any name, word, device, symbol, or any combination, intended to be used when conducting business in the marketplace by someone other than the owner of the mark.

Collective Marks
A collective mark is any trademark or service mark used by a defined group of people, such as a union or an association.

Levi Strause - Red Tab on pocket of denim jeans
During the gold rush, Levi Staus headed to San Franscisco to sell canvas for tents. The miners insisted that there was a need for pants, so Staus had the canvas sewn into pants. Later, the canvas material was replaced and evolved into denim, making Straus first marketer of blue jeans. In 1936, Straus registered the red tab located on the top left pocket of each of his denim jeans as a trademark.

McDonald's Arches
In 1972, McDonalds enacted one of the first 3D trademarks in relation to its popular arch signs.

Coca-Cola Bottle
In 1977, The Coca-Cola bottling company registered the shape of its bottles as a trademark. Other countries like Japan have acknowledged the 3 dimensional trademark as well.

Owens-Corning Pink Insulation
On May 12, 1987, Owens-Corning registered the color pink as a trademark color for its insulation product. Previously, they were using the Pink Panther symbol in conjunction with advertising for its product with the permission of the owners of Pink Panther.
